CDEF – Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE CDEF APPLICATION.

These Terms of Service (“Terms”) govern your access to and use of the CDEF mobile application and related services (“CDEF”, “App”, “Service”) provided by eDacs Research and Development Private Limited (“Company”, “we”, “our”, “us”). By downloading, installing, accessing, or using CDEF, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use CDEF. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on a mobile device you own or control and
  • Access and use the App solely for your personal, non-commercial use (unless otherwise authorized in writing).

We reserve all rights not expressly granted to you in these Terms.

3. User Account and Security

To use certain features, you may need to create an account using your mobile number and OTP verification. You agree to:

  • Provide accurate and up-to-date information;
  • Maintain the confidentiality of your device and SIM card;
  • Promptly notify us if you suspect unauthorized use of your account or device.

We are not liable for any loss or damage arising from your failure to safeguard your device or account access.

4. Permitted Use and Restrictions

You agree not to:

  • Use CDEF for any unlawful, fraudulent, or malicious purpose;
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the App;
  • Interfere with or disrupt the integrity, security, or performance of the App;
  • Use the App to harass, abuse, defame, or harm others;
  • Upload or share any content that is illegal, harmful, or violates the rights of others;
  • Circumvent any access or security controls of the App or our servers.

We reserve the right to suspend or terminate your access if we reasonably believe that you have violated these Terms or are using the App in a harmful or unlawful manner.

5. Caller Identification and Reputation Data

CDEF provides caller identification, spam/fraud alerts, and reputation scores based on available data sources, user reports, and automated analysis.

You understand and agree that:

  • Caller identification or reputation scores may not always be accurate, complete, or up to date;
  • CDEF is a decision-support tool, and you remain responsible for your own decisions regarding calls and communications;
  • You will not use CDEF data to stalk, harass, discriminate against, or otherwise misuse information about other individuals or businesses.

6. User Content and Reports

You may submit information such as reports of spam, fraud, or suspicious numbers (“User Content”). By submitting User Content, you:

  • Represent that the information is, to the best of your knowledge, accurate and lawful;
  • Grant us a worldwide, non-exclusive, royalty-free, transferable license to use, store, reproduce, modify, and display such content as necessary to provide and improve CDEF;
  • Agree that we may, at our discretion, review, moderate, or remove any content that we believe violates these Terms or applicable law.

7. Third-Party Services

CDEF may use or link to third-party services (e.g., telecom providers, analytics services, cloud platforms). We do not control and are not responsible for the content or practices of third-party services. Your use of such services is governed by their own terms and policies.

8. Updates and Changes to the App

We may provide updates, patches, or new versions of the App from time to time to improve performance, security, or features. We may also modify or discontinue certain features or functionalities. Where required by platform rules, you may need to accept updates to continue using the App.

9. Privacy

Your use of CDEF is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you acknowledge that you have read and understood the Privacy Policy.

10. Disclaimer of Warranties

CDEF IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The App will be error-free or uninterrupted;
  • Caller identification or reputation information will always be accurate or complete;
  • Any defects or errors will be corrected within a particular timeframe.

You use the App at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Holaray Innovations Private Limited, its directors, employees, or affiliates be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages; or
  • Any loss of profits, data, goodwill, or other intangible losses

Arising out of or relating to your access to or use of (or inability to use) CDEF, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising out of or related to these Terms or your use of the App shall not exceed the amount you have paid, if any, for using the App in the twelve (12) months preceding the claim or, if greater, the equivalent of USD 10.

12. Indemnity

You agree to indemnify and hold harmless Holaray Innovations Private Limited, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the App;
  • Your violation of these Terms;
  • Your violation of any rights of another person or entity.

13. Unknown Caller

Definition of an Unknown Caller

An "Unknown Caller" is defined as any incoming caller whose number is not present in the CDEF verified database at the time the call is received. Such numbers have not been matched to any registered individual, organisation, or entity within our records.

These calls are flagged automatically by the CDEF system and labelled accordingly on the user's interface in real time, at the moment of the incoming call.

Unknown Caller Label & Alert Popup

When a call is received from an Unknown Caller, users will be shown an on-screen alert label and a caution popup notification. The popup is displayed in purple and is designed solely to inform the user that the caller's identity could not be verified against the CDEF database.

The popup does not imply any confirmed threat, fraudulent activity, or malicious intent on the part of the caller. It serves as a neutral informational notice only, based solely on the absence of a matching record in the CDEF database.

Unknown Number

This caller is not in the CDEF database. Exercise caution at your discretion.

Note: No threat data, fraud score, or security risk rating is displayed on the label. The notification is informational only.

User Discretion & CDEF Limitation of Liability

Upon receiving an Unknown Caller notification, the decision to answer, continue, or terminate the call rests solely with the user. CDEF provides caller identification as an informational service and does not direct, advise, or instruct users on how to respond to any specific call.

By accepting these Terms & Conditions, the user acknowledges and agrees that:

  • CDEF bears no responsibility, legal liability, or obligation for any harm, loss, fraud, financial damage, emotional distress, or adverse outcome of any kind arising from a user's decision to engage with or respond to an Unknown Caller.
  • CDEF's Unknown Caller label is a system-generated notification based solely on the absence of a matching record in our database. It does not constitute legal advice, a security assessment, or any guarantee of caller safety or danger.
  • Any interaction between the user and an Unknown Caller, once the call is accepted, is entirely at the user's own risk. CDEF disclaims all liability for events occurring during or after such a call.

Important: Once a call is accepted by the user, CDEF bears no responsibility for any outcome arising during or following that call.

No Threat Assessment or Security Guarantee

CDEF does not perform real-time threat analysis, behavioural profiling, or fraud scoring on Unknown Callers. The caution label displayed is a system notification only and carries no security rating, risk score, or threat classification of any kind.

Users are encouraged to exercise personal caution and to report any suspicious calls through the appropriate reporting channels within the CDEF platform, or to contact their local authorities as applicable.

14. Termination

We may suspend or terminate your access to CDEF at any time, with or without notice, if we reasonably believe that you have violated these Terms, used the App in a harmful manner, or if we discontinue the App. You may stop using the App at any time by uninstalling it from your device.

Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnity, and governing law) shall continue in effect.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. You agree that any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in India, unless otherwise required by applicable law.

16. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last Updated” date above and may provide additional notice within the App. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
